SESSION FEE: The session fee is a non-refundable retainer and is due immediately upon booking. Date and time are not held until fee is paid in full. The session fee pays for the creative talent, time spent preparing and consulting with the client as well as time spent photographing, carefully hand selecting and professionally editing your images. Finally, it includes access to a private online gallery with images from your session for you to choose from. It does NOT include any finished portraits.
WARDROBE: PJ Portrait Photography will provide information on how clients can look their best for your portraits. During the pre-consultation, hair, make up, nail polish color, tattoos, clothing colors and other wardrobe choices will be discussed. However, client is ultimately responsible for coordinating all wardrobe choices. PJ Portrait Photography is not responsible for wardrobe choices that may affect the quality of the final portrait. Additional editing fees will be charged to fix make up, hair, remove tattoos, remove wrinkles from clothing or fix nail polish for example.
TRAVEL: Travel fees may apply (15-mile radius from Ramsey, MN is included unless otherwise stated), $0.63 per mile thereafter. Mileage fee is in accordance with IRS and MN state mileage rates and subject to change. When photographing at senior living facilities, this travel fee is waived.
TARDINESS: Please plan enough time to get to your session. Whether that be getting the kids ready or navigating through rush hour traffic. If you are running late, please call me. I respect every single client's time and put an incredible amount of effort into scheduling and planning a session, so please respect mine. If you have a 60-minute session scheduled and you are 20 minutes late, you will then have a 40-minute session. I, of course, understand unforeseen circumstances such as illness or accidents. If I am late, I will communicate that with you and your session time will not be affected.
RESCHEDULING: I understand that life happens. People get sick, and things go wrong. If you need to reschedule for any reason, please give me 72 hours notice. If you happen to fall ill the day of your session, please call to reschedule. I work every day with all age groups and cannot risk passing on anything to our beloved clients. Your photos will look better if you are feeling well rested and at your best! I rarely allow weather rescheduling because after all, we do live in Minnesota, so I love to embrace whatever weather conditions happen to be that day. If it is down pouring and sideways rain that hinders our photo session, I can without a doubt reschedule. PJ Portrait Photography reserves the right to reschedule within 24 hours of the session.
CANCELLATIONS: If you no-call no-show, I will not schedule with you again. Please be mindful that when I block off a time slot for you, I am holding that spot for only you. Therefore, I am not able to schedule someone else.
LIMIT OF LIABILITY: If PJ Portrait Photography cannot perform its contract due to fire or another casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographers illness or emergency, then the Photographer shall return any deposit or pro-rated session fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event the photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount in excess of the retail value of the Clients order.
PHOTOGRAPHIC RENDERING: While I do capture many images during your session, PJ Portrait Photography reserves the right to show only the images that meet the standards and expectations of a quality image. Images with eyes closed, heads turned and duplicates will not be shown and will be permanently deleted. All images are photographed in color but are available in black and white at no additional charge.
PHOTOSHOPPING OF IMAGES: All images purchased are professionally edited. Additional special request edits can be done with rates starting at $40 per image.
SESSION ORDERS: I require full payment for prints and products at your ordering session. I accept cash and most major credit cards. No order will be edited, designed or submitted to the lab until everything is paid in full. Online galleries and social media sneak peeks will not be posted until all payments are made. You will receive a print release for all purchased products.
DIGITAL IMAGES: PJ Portrait Photography provides photographic prints and products, color corrected & calibrated to print EXACTLY as seen on my computer monitor and the professional print lab. Any digital photos you see (on the website or on social media sites may vary from their intended appearance, depending on your computer's monitor and settings. PJ Portrait Photography cannot guarantee the results or quality of prints made by clients or by clients' chosen labs. For consistent, quality results made to last a lifetime, please purchase your prints directly from PJ Portrait Photography. Digital files purchased or provided are for personal archival purposes. I include a print release for photographic prints only, in sizes 8x12" and smaller. Please back up all digital copies of your photographs. I recommend an external hard drive or flash drive. PJ Portrait Photography will make every effort to retain your files for up to one year from the date of your session.
ALL SALES FINAL: Due to the custom nature of this work, all sales are final. No substitutions, exchanges or refunds are available after placing your order. Replacement will only be given in the case of damage caused by PJ Portrait Photography.
PHOTOGRAPHER USAGE: Unless specified in writing, the client gives PJ Portrait Photography permission to use all images from your session, including behind-the-scenes audio, video and still images and social media live feeds, without name identification, in all media formats for advertising and marketing purposes. All images are the property of PJ Portrait Photography and thus PJ Portrait Photography reserves the right to use any image for display, publication, or other purposes.
COPYRIGHT INFORMATION: PJ Portrait Photography, LLC. owns the copyright to all images from your session. Any unauthorized use of these images violates copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. A purchased photograph may not be used in any publication, reproduced, in part or whole, displayed (including on social media) or manipulated in any way, (using AI for example), without the prior written permission of PJ Portrait Photography. Taking screenshots of images from your gallery at any time (even if they are watermarked) is a violation of copyright and is illegal. Removing watermarks from images is illegal and you will be notified and charged a fine of $500 per image if you have been found to share these unedited images on social media. Any unauthorized copying, printing, or scanning images from any online sources such as our website, Facebook page or from any physical materials including prints, press printed materials and canvases, regardless of the intent for use, is considered a violation of copyright laws and violations will be prosecuted under current copyright laws.
